Study: Driving While Texting as Dangerous as DUI

With California lawmakers ready to vote Thursday on an emergency order banning train operators from using cell phones, a new study finds the practice of DWT — driving while texting — is a growing danger on the nation’s roads.

According to a new survey conducted by Nationwide Mutual Insurance, one in five drivers in a admitted to texting while behind the wheel. A second survey on FindLaw.com, a legal website, found nearly half of drivers age 18 to 24 admitted to sending text messages, instant messages or e-mail messages while driving.

U.S. dependency on foreign oil has reached an economic crisis point. Now dependent on foreign nations for 70 percent of its oil, the U.S. is exporting $700 billion annually, more than four times the cost of the Iraq war, said T. Boone Pickens, who has worked in the oil and gas industry for nearly six decades.

Pickens said that he will fund an aggressive multi-media advertising and internet education campaign designed to focus attention on this crisis and to advance an energy plan of his own dubbed “The Pickens Plan,” that, if adopted, would reduce foreign oil dependency by more than one-third. Much of this oil is acquired from some of the most volatile countries in the world, putting our national security and economy security at risk. The plan calls for investing in power generation from domestic renewable resources such as wind and using our abundant supplies of natural gas as a transportation fuel, replacing more than one-third of our imported oil, saving more than $230 billion a year.




California DUI Law – NEW DUI LAWS GO INTO EFFECT JAN 1, 2009

WATCH OUT FOR NEW 2009 PENALTIES

Beginning in January 1, 2009, drivers on probation for any DUI conviction face zero tolerance if they drive on California highways with a blood or breath alcohol concentration of .01% or higher.

On October 14, 2007, the Governor of California signed a number of bills. New Vehicle Code §§23154 and 13389, and the amended 13353.1, have come to life per AB 1165 introduced by Assembly Member Maze (Coauthors: Assembly Members Sharon Runner and Spitzer) February 23, 2007.

These sections take effect on January 1, 2009 according to the Legislature’s enrolled document.

New Vehicle Code §23154 states:

(a) It is unlawful for a person who is on probation for a violation of Section 23152 or 23153 to operate a motor vehicle at any time with a blood-alcohol concentration of 0.01 percent or greater, as measured by a preliminary alcohol screening test or other chemical test.
(b) A person may be found to be in violation of subdivision (a) if the person was, at the time of driving, on probation for a violation of Section 23152 or 23153, and the trier of fact finds that the person had consumed an alcoholic beverage and was driving a vehicle with a blood-alcohol concentration of 0.01 percent or greater, as measured by a preliminary alcohol screening test or other chemical test.


(c) (1) A person who is on probation for a violation of Section 23152 or 23153 who drives a motor vehicle is deemed to have given his or her consent to a preliminary alcohol screening test or other chemical test for the purpose of determining the presence of alcohol in the person, if lawfully detained for an alleged violation of subdivision (a).


(2) The testing shall be incidental to a lawful detention and administered at the direction of a peace officer having reasonable cause to believe the person is driving a motor vehicle in violation of subdivision (a).


(3) The person shall be told that his or her failure to submit to, or the failure to complete, a preliminary alcohol screening test or other chemical test as requested will result in the suspension or revocation of the person’s privilege to operate a motor vehicle for a period of one year to three years, as provided in Section 13353.1.

New Illinois DUI Law To Take Effect

SPRINGFIELD, ILLINOIS – Illinois Secretary of State Jesse White and Mothers Against Drunk Driving have joined forces to raise public awareness for a groundbreaking new DUI law set to take effect Jan. 1 in Illinois. The new law requires all first-time offenders who wish to obtain driving relief during the period of statutory summary suspension to install on their vehicles a breath alcohol ignition interlock device.

The offender will be responsible for the cost of the device; which will be $100 rental and a monitoring fee $110 per month. DUI offenders who cause death, great bodily harm, are under 18 years of age or have a prior conviction of reckless homicide are ineligible for driving relief.
