WY SR22 Requirements
In the state of Wyoming it is illegal to drive a vehicle with a blood alcohol concentration (BAC) of .08 or higher. There are stricter laws for drivers of commercial vehicles and also for drivers under the age of 21. The drunk driving laws of Wyoming also make it illegal to drive under the influence (DUI) of controlled substances such as barbiturates, marijuana, stimulants, inhalants and any other intoxicants. Penalties for a first-time DUI are as follows:

  • Up to 6 months in jail, or
  • Up to $750 fine, or both
  • License suspension for 90 days
  • An ignition interlock device may be required for 6 months
  • Substance abuse assessment required

Subsequent DUI convictions cause the penalties to increase.

Wyoming has an implied consent law which means that you have given your consent to be tested to determine the alcohol or drug content of your blood, breath or urine if stopped by an officer and he suspects that you are driving under the influence of drugs or alcohol. A first time refusal to submit to the test will result in your driver’s license being suspended for a period of 6 months, a second refusal requires an 18 month suspension.

The minimum required liability insurance coverage is as follows:

  • $25,000 for Bodily Injury Liability for injury per person
  • $50,000 for Bodily Injury Liability per accident
  • $20,000 for Property Damage Liability per accident for property damage

Law enforcement officers can ask you for proof of insurance at any time if they stop you for a traffic violation or if you’ve been involved in an accident. If a law enforcement officer sites you for driving a vehicle without insurance, you will be fined $250 up to $750.

TX SR22 Requirements
The State of Texas prohibits the operation of a vehicle by drivers with a blood alcohol concentration (BAC) of .08% or higher. There are lower limits in place for commercial drivers of .04% and for drivers under the age of 21 of .02% BAC.

Or, for any other reason that a judge deems it necessary for you to prove to the state that you are financially responsible.

Penalties for a first drunk driving conviction are:

  • 72 hours to 180 days in jail
  • Jail of from 180 days to 2 years if a child under the age of 15 is in the vehicle
  • Fines up to $2,000.00
  • Fines up to $10,000.00 if a child under the age of 15 is in the vehicle
  • License suspension from 90 to 365 days
  • DWI Surcharge – $1,000.00 per year for 3 years
  • DWI Surcharge – $2,000.00 per year for 3 years if BAC is .16 or above

In the State of Texas the implied consent law means that any person who receives a driver’s license automatically consents to a chemical test of their blood, breath or urine to determine BAC or the presence of drugs. If you refuse a chemical test your driver’s license will be confiscated and during your hearing the court may rule to suspend your license.

The minimum insurance coverage for private passenger vehicles per the Texas Department of Insurance is as follows:

  • $25,000 for bodily injury liability to one person
  • $50,000 for bodily injury liability to more than one person
  • $25,000 for property damage liability

OH SR22 Requirements
It is against the law in the state of Ohio for a driver to operate a vehicle with a blood alcohol concentration (BAC) of .08 or higher. In Ohio a DUI is called Operating a Vehicle Intoxicated (OVI). The OVI law in Ohio includes alcohol, or drugs or both.

Penalties for a first time OVI offense in the state of Ohio are as follows:

  • 72 hours to 6 months in jail, or a Driver Intervention Program for 3 days
  • 6 days in jail if the BAC is .17 or above
  • License suspension for 90 days up to 3 years
  • A reinstatement fee of $450
  • Fines from $250 to $1000
  • A special form, SR-22, may be required from the BMV to be filed with the insurance policy

The SR-22 in Ohio is required for a minimum of 36 consecutive months. The judge will determine the period during sentencing based on the severity of the crime. As an example, if your driver’s license is suspended for five years due to a DUI or some other serious violation, then the judge can require you to carry the SR-22 for five years as well.

Failure to keep your car insurance policy active when you have an SR-22 is a serious problem. If your policy has a lapse in coverage due to failure to make the payment, or for any other reason, will cause the SR-22 filing period to start over from the beginning. This could mean a minimum of another three years having the SR-22 filed with your insurance policy.

An SR-22 shows the Bureau of Motor Vehicles (BMV) that you have at least the state minimum coverage for liability insurance. Most insurance companies file the SR22 with the BMV electronically.

The minimum required liability insurance coverage is as follows:

  • $12,500 for Bodily Injury Liability per person injured in one accident
  • $25,000 for Bodily Injury Liability for all persons in one accident
  • $ 7,500 for Property Damage Liability for destruction of property

It is unlawful in the State of Washington for a driver to operate a vehicle with a blood alcohol concentration (BAC) of .08 or higher. In addition, the BAC level for a commercial driver is .04 and for drivers who are under the age of 21 it is .02.

Penalties for a first time DUI offense in the State of Washington are as follows:

  • 24 hours to 12 months in jail
  • The courts may allow a 15-day minimum home electronic monitoring program in lieu of jail time which is paid for by the driver
  • License suspension for 90 days
  • A fine of no less than $865 or up to $5,000
  • An ignition interlock device can be ordered
  • A special form, SR-22, may be required from the Department of Licensing to be filed with the insurance policy

All drivers in the State of Washington are required to have liability insurance coverage with at least the following limits:

  • $25,000 for an injury to another person
  • $50,000 for injuries to all other persons in the accident
  • $10,000 for property damage

FL SR22 Requirements
The drunk driving laws in the State of Florida prohibits a driver to operate a vehicle with a blood alcohol level (BAL) of .08 or higher. In addition, the BAL level for a commercial driver is .04 and for drivers who are under the age of 21 it is .02.

Penalties for a first time DUI offense in the State of Florida are as follows:

  • 6 months maximum in jail for BAL of .08 but less than .15
  • 9 months maximum in jail for BAL above .15
  • A fine of from $500 to $1000 for BAL of .08 to .15
  • A fine of from $1000 to $2000 for BAL above .15 or if there is a minor in car
  • License suspension from 180 days to 1 year
  • For a Hardship Reinstatement of the license, the driver must complete DUI School prior to applying for the hardship
  • An ignition interlock device may be required
  • A Community Service Fine of $10 for each hour of community service required
  • Community Service of 50 hours
  • A Treatment Program may be allowed in lieu of imprisonment
  • Vehicle impoundment of 10 days

Florida will require the driver to have an SR22 filed with the state as proof of a liability policy in order to get the license reinstated after the license has been suspended or revoked. Once filed, the SR22 and the liability insurance must continue to be active. If the driver cancels the insurance policy, and therefore the SR22, for any reason the State of Florida Department of Highway Safety and Motor Vehicles will be notified. Drivers are required to carry the SR22 auto insurance documentation for up to 3 consecutive years.

If a driver is convicted of a DUI offense after October 1, 2007, then the driver is required to provide proof of bodily injury liability insurance as follows:

  • $100.000 per person
  • $300,000 per occurrence
  • $50,000 property damage liability

KY SR22 Requirements
An SR22 is not required in the state of Kentucky after a drunk driving conviction. The state of Kentucky prohibits a driver to operate a vehicle with a blood alcohol concentration (BAC) of .08 or higher. There are lower BAC limits for drivers of commercial vehicles and for drivers under the age of 21.

The state has harsher penalties for a DUI with aggravated circumstances such as transporting a child under the age of twelve (12), driving 30 MPH over the posted speed limit, driving in the wrong direction on a limited access highway, causing an accident while impaired that causes injury or death, a BAC of .18 or above, for refusing a DUI test and other violations as determined by the state.

In Kentucky the first drunk driving conviction carries the following penalties:

  • Jail from 2 days up to 30 days
  • Jail of 4 days for an Aggravated DUI conviction
  • A fine from $200 to $500
  • Suspension of your driver’s license for 30 to 120 days
  • Alcohol or Drug Treatment Program for 90 days
  • Community labor for a minimum of 48 hours, up to 30 days

Kentucky has an implied consent law which means that you have given your consent to submit to a chemical test of your blood, breath or urine if stopped by an officer and he suspects that you are driving impaired. Refusal to submit to the test will result in your driver’s license being suspended for a period of 30 to 120 days.

The minimum required insurance is as follows:

  • $25,000 for death or injury of one person
  • $50,000 for death or injury of two or more persons per accident
  • $10,000 for damage to property
  • $25,000 for death or injury of one person
  • $50,000 for death or injury of two or more persons per accident
  • $10,000 for damage to property
  • $10,000 for Basic No Fault (PIP coverage) unless rejected

Drivers must carry proof of Kentucky car insurance in their vehicle at all times and present it to any law enforcement officer if they stop you for any reason. When renewing or transferring a motor vehicle registration, proof of insurance must be shown to the county clerk. Insurance companies operating in Kentucky are required to electronically report all personal auto insurance information to the Department of Motor Vehicles (DMV).

The drunk driving laws in the State of New York prohibits a driver to operate a vehicle with a blood alcohol concentration (BAC) of .08 or higher. In addition, the BAC level for commercial drivers and for drivers who are under the age of 21 are lower. Drivers under the age of 21 are held to a zero tolerance and a minor could lose the privilege to drive until they reach adulthood.

The first conviction for driving while intoxicated (DWI) in New York with a BAC of .08 or higher is a misdemeanor. You can be fined from $500 to $1,000 and you could be sent to jail for up to 1 year. Your driver’s license will be suspended for at least 6 months and you will have to pay a mandatory conviction charge.

Penalties for a first time DWI offense in the State of New York are as follows:

  • Up to 1 year in jail
  • A fine of from $500 to $1000
  • License suspension for at least 6 months
  • Pay a Mandatory Surcharge for conviction
  • Mandatory alcohol screening and/or alcohol evaluation

Other possibilities include:

  • Ignition interlock device installation
  • Driver Responsibility Assessment

If there is a passenger under the age of 16 in the vehicle, the penalties are increased:

  • The DWI is now a Class E Felony
  • The fine is up to $5,000 and/or up to 4 years in jail

Subsequent DWI convictions cause the penalties to increase.

  • Personal Injury Protection

In the State of Illinois driving under the influence (DUI) is classified as a violent crime. If you are convicted of a DUI offense, the violation will remain on your driving record permanently. It is against the law for a driver to operate a vehicle with a blood alcohol concentration (BAC) of .08 or higher. A DUI includes alcohol, or drugs or both, and any other intoxicants.

Penalties for a first time DUI offense in Illinois are as follows:

  • Jail up to 1 year possible
  • If a child under 16 is in the vehicle, add 6 months of additional jail time
  • A fine up to $2500
  • Add an additional $500 minimum if the BAC is above .16
  • Add $1000 minimum if a child under 16 is in the vehicle
  • License suspension a minimum of 1 year
  • A Breath Alcohol Ignition Interlock Device is possible
  • Suspension of the vehicle registration
  • Community service of 100 hours minimum if BAC is above .16
  • Community service of 25 days if a child under 16 is in the vehicle

If you are convicted of a DUI you are also subject to filing a Financial Responsibility Form SR22 for 3 years. Before you can drive again, you must undergo an alcohol/drug evaluation and successfully complete a rehabilitation or alcohol/drug education program.

Drivers must have vehicle liability insurance with the following minimum coverage:

  • $20,000 for injury or death of one person injured in an accident
  • $40,000 for injury or death of more than one person in an accident
  • $15,00 for damage to property of another person
