Cheap SR22 Insurance in OR

OR SR22 Requirements
The state of Oregon prohibits a driver from operating a vehicle if the driver has a blood alcohol concentration (BAC) of .08 or higher. There are stricter laws for drivers of commercial vehicles (.04) and a .02 or a Zero Tolerance limit for drivers under the age of 21. The Oregon DUI law also prohibits driving under the influence of other intoxicants such as inhalants, marijuana, cocaine and many other drugs.

The list of penalties for a first time Oregon DUI offense is as follows:

  • DUI Diversion Program possible
  • Sentenced to jail for a minimum of 48 hours or up to 1 year, or
  • Community service of 80 hours
  • A fine of $1,000 minimum
  • $2,000 fine if the BAC is .15 or higher
  • $10,000 fine possible if a child under 18 is in the vehicle
  • Other DUI fines at a minimum of $300
  • License suspended for 1 year
  • Ignition interlock device required for 1 year after the suspension
  • The participation in the Victim-Impact Panel Program
  • Alcohol evaluation and treatment may be ordered

Subsequent DUI convictions cause the penalties to increase.

Oregon state law requires an SR-22 to be filed with the Department of Motor Vehicles for the following reasons:

  • Failure to provide proof of liability insurance to the DMV
  • If you’ve been involved in an uninsured accident
  • If you’ve been convicted of driving without insurance
  • If you were convicted of a DUI and are reinstating your driver’s license
  • If you are applying for a hardship or probationary permit

There could be other reasons why a judge or the Department of Motor Vehicles might require you to file an SR-22.

The SR 22 is a certificate that gets filed with the DMV by your insurance company that shows your future financial responsibility and proof that the liability insurance meets the minimum required limits of coverage. Oregon law requires the SR 22 to be in effect for 3 years from the end of the license suspension or for 3 years and 33 days from the date of the driving without insurance conviction.

The DMV monitors the SR-22 compliance of your SR-22 requirement. If the insurance, and therefore the SR-22, lapses for any reason, the insurance company will contact the DMV and your driver’s license will be suspended.

The State of Oregon has a mandatory insurance law which requires all drivers to insure their vehicles. The minimum required liability insurance coverage is as follows:

  • $25,000 for Bodily Injury Liability per person
  • $50,000 for Bodily Injury Liability for bodily injury to others
  • $25,000 for Property Damage Liability for damage to property of others
  • $15,000 for Personal Injury Protection
  • $25,000 for Uninsured Motorist Coverage per person for bodily injury
  • $50,000 for Uninsured Motorist Coverage per crash for bodily injury

You are required to certify that you have at least the minimum insurance each time you register a motor vehicle in the state of Oregon.

If you drive without liability insurance you can be fined, your driver’s license can be suspended and your vehicle can be towed. If you drive a vehicle that is uninsured and are involved in an accident, your driving privileges will be suspended for one year. If you are convicted of driving uninsured, a judge can require you to file proof of financial responsibility with the Department of Motor Vehicles (DMV) using the SR-22 form which is required for 3 years. If you do not file the SR-22, your driver’s license will remain suspended.

Should I File An Insurance Claim?

Times not to File A Claim against Your Insurance

An insurance policy is protection for you in a case of a significant loss. It doesn’t matter whether it’s a loss with your home or with your automobile, both can incur large damages from accidents or incidents. In the case of a significant financial loss from an accident, you probably would be best served to file a claim against the policy. However there are times with minor accidents which don’t cost a lot or if you recently had filed another larger claim where not filing a claim might be the best approach for you.

Insurance companies keep track of claims filed by their policy holders. If you file what they see as too many claims over a period of time, they might be inclined to raise your rates, or even non-renew your policy. Filing a claim should be done for big losses and not for the smaller ones in order to help the perception held of you by the insurance company.

Most insurance companies look at your Motor Vehicle Record (MVR) at the inception of your policy. The rate they will quote you is based on a lot of information about you and your car, and one of them is the MVR. A lot of insurance companies will not take the time to re-run your MVR at the 6-month renewal or even at the annual renewal unless there’s a change of circumstances. Filing a claim is a change of circumstance and gives the insurance company an opportunity to recheck your MVR as they look at your claim. If they find additional violations on your MVR, they can raise your rates for either or both events.

If your insurance policy has a deductible that you have to pay that applies to the loss and the pay-out from the loss is not that significant after you’ve paid the deductible, then that’s another instance of when you might not want to file the claim.

When you’re involved in a traffic accident, be sure to get as much information from the other driver as possible, especially their insurance information. It is much better for you to have the other party’s insurance pay for the damages rather than for you to file a claim against your policy.

NJ DWI Requirements
In New Jersey it is illegal to drive a vehicle with a blood alcohol concentration (BAC) of .08 or higher. New Jersey has lower limits for commercial drivers and for minors under the age of 21. There are also laws that prohibit driving while under the influence of drugs and for driving while possessing drugs. The penalties for a first time DWI conviction are as follows:

  • • Up to 30 days in jail
  • • Fine from $250 to $400
  • • Fine from $300 to $500 if the BAC is .10 or higher
  • • License suspension for 3 months
  • • License suspension for 7 months to 1 year if the BAC is .10 or higher
  • • Installation of an interlock device is possible
  • • Other DWI fees – minimum of $525
  • • Automobile insurance surcharge of $1,000 for 3 years
  • • Attend the Intoxicated Driver Resource Center for 2 days for 6 hours per day

Subsequent DWI convictions cause the penalties to increase.

New Jersey has an implied consent law which means that you have given your consent to a chemical test of your blood, breath or urine if stopped by an officer and he suspects that you are driving while intoxicated. Refusal to submit to the test will result in your driver’s license being suspended for 1 year and you will be fined from $250 to $500.

The minimum liability insurance coverage is as follows:

  • $15,000 for injury to a person
  • $30,000 per accident if several people are injured
  • $5,000 for property damage
  • $15,000 for Personal Injury Protection

What to Expect When Charged with a DUI/DWI

If you are ever arrested and subsequently convicted of a Driving Under the Influence (DUI) violation, you are in for a lengthy process with law enforcement, the judicial system, the Department of Motor Vehicles, Alcohol Treatment Programs, and your own budget.

In the case of a DUI a law enforcement officer can put you through a field sobriety test and can arrest you on the spot.  In some states you can go immediately to jail for up to 24 hours, and upon conviction, be possibly sentenced for even more jail time.

 Once convicted of a DUI your driver’s license can be suspended for 30 days and to up to 3 years in some states.

The judge can order you to attend an alcohol treatment program and could also require you to install an ignition control device in your car.  Both of these are very expensive.

You can expect to have several different fines and reinstatement fees to deal with during the process and you haven’t even gotten to the point where you can drive yet.

When you have gotten through to the point where you can finally obtain your driver’s license, you’ll need a car insurance policy with at least the state’s minimum liability requirements and an SR22 filing if ordered by the judge. Lots of insurance related websites will put fear into you and tell you that your auto insurance will be really expensive and hard to get.  While it is true that not all insurance companies will take a driver who is required to have an SR-22, there are companies that do offer that type of coverage and some even specialize in SR-22 insurance and filing.

The point of all of this is to advise you not to give up.  Set yourself a budget with these costs in mind so you will be able to handle the expense.  Some states require the SR22 filing to be active for 36 consecutive months and will force you to start over if you have a lapse in coverage because of a missed payment or for any other reason, so it is important to maintain your coverage throughout the required timeframes.
